At We Are One Foundation (“we,” “our,” “us”), we understand and appreciate that your decision to choose us is an expression of confidence. You trust us to keep secure any information we obtain from you or about you. We understand that privacy is important, and we are strongly committed to protecting the privacy of both our current and prospective patrons as well as visitors to our Website.

COLLECTING OF INFORMATION

1.1 The personal information that we collect includes your name, address, city, state, zip, telephone number, e-mail address. In addition, we may collect your credit card information as part of a donation that you make.

1.2 We may use your information to process your purchase or donation. We may also use your information to add you to our mailing list for monthly newsletters and other organizational communications.

1.3 If we add you to our mailing list, you will always have the option to be removed from that list at any time.

1.4 If we collect your credit card information, it will only be used to process your donation/s.

CHILDREN

2.1 Other than information required to complete a subscription, We Are One Foundation does not knowingly collect personal identifiable information from children under the age of 13.

2.2 If a child under 13 has provided us with personal information without parental or guardian consent, the parent or guardian may contact us by emailing us at We1are1@gmail.com.  We will remove the information and unsubscribe the child from any of our electronic marketing lists.  Where required by applicable law, we may ask children for consent from their parents or guardians before we provide product, service, or donation to them.

3.1 If you would like to be removed from our mailing list, please use the “contact us” page on our website or email us at We1are1@gmail.com. Simply give us your name and address and indicate your desire to be removed from our list in the comments section of this form.

3.2 To be removed from our email list, simply click on the unsubscribe link provided on each email and follow the instructions.

4.1 We Are One Foundation will never trade, share or sell your personal information with anyone else, nor send donor mailing on behalf of other organizations. We guarantee that your identity will be kept confidential. Your personal information will only be used for internal We Are One Foundation purposes.

13.1 Our presentation of donations, goods and/or services on our website, whether such donations, goods and/or services have prices displayed with them or not, constitutes an invitation to treat and not an offer.

13.2 By placing an order or donation on our website or otherwise (e.g. over the phone or by email), you are making an offer to donate or purchase the goods and/or services which you have added to your cart.

13.3 We may accept your offer, and thereby enter into a binding contract (in the form of these Terms of Sale) with you, by sending you an order or donation receipt confirmation to the email address you have provided when you placed your order.

13.4 If we are unable to accept your order or donation, we will endeavour to inform you of this in writing, and the reasons about why we are unable to accept your order or donation, as soon as reasonably practicable after you have placed your order or donation.

13.5 Please contact us if you have not received the products and/or services which you have ordered within 24 hours of the time when you placed your order. Or if your donation has not come through.

13.6 Your payment for your order or donation will be processed by one of our payment providers, PayPal.

13.7 We reserve the right to refuse service or products to any subject to special conditions where we believe that your use of our services or products would negatively impact our business or reputation, including, without limitation the requirement that any links or references to us or our website are removed.

14.1 By placing an order for donations, goods and/or services on our website, you agree to be bound by these Terms of Sale.

14.2 If for any reason whatsoever you do not agree to these Terms of Sale or do not wish to be bound by them, you must not purchase goods or service or donate on or via our website.

14.3 You must pay for the goods and/or services and donations you order using a credit or debit card, via PayPal. If we accept any other method of payment, if it will be made available to you prior to you placing your order or via one of our third party payment processors (being PayPal or any other third party payment processor we use from time to time).

14.4 Unless otherwise agreed in advance of donation or purchase, payment must be made for our donations, goods and/or services prior to their delivery or being made available.

PAYMENT

15.1 We may change the prices quoted for our goods and services displayed on our website from time to time.

15.2 The price you will need to pay for your donations, goods and/or services will be confirmed to you at the point when you place your order at the checkout stage, unless there is a manifest error in the price at that time (e.g. the price quoted is at least 10% higher or lower than the prices quoted elsewhere on our website), in which case you should inform us of this fact before you place your donation or order and/or we will notify you of the error soon after you place the order or donation and a binding contract will not be formed.

15.3 We will seek to resolve any such price discrepancy as soon as reasonably practicable and confirm the correct price for the donation, goods and/or services you have ordered and enter into these Terms of Sale with you on the basis of the correct price.

15.4 Unless we inform you or agree otherwise, you must make payment in full for the donations, goods and/or services you order on or via our website at the time when you place your order or donation. We will provide you or begin providing you with the donations, goods and/or services only once we have received that payment and shall be under no obligation to provide you with such donations, goods and/or services if we have not received such payment.

15.5 Unless we are physically delivering any goods and/or services to you there will be no delivery charges associated with your order of our products and/or services. Where any delivery charge is payable, it will be visible at the checkout stage or otherwise confirmed to you before you place your order for our goods and/or services.

15.6 Once the free trial period to our Monthly Subscription has ended, you may cancel your subscription at any time but such cancellation will only take effect at the end of the period for your subscription and there is no refund for any fees already paid for that period. Unless stated otherwise, the subscription period for our legal update platform shall be month to month.

INTELLECTUAL PROPERTY 

16.1 Intellectual property created, made, or originated by a faculty member shall be the sole and exclusive property of the faculty, author, or inventor, except as he or she may voluntarily choose to transfer such property, in full, or in part.

​SHARING AND USE OF INTELLECTUAL PROPERTY

17.1 Anything that enjoys copyright protection, whether it's rendered in ink or pixels, may not be copied or published elsewhere without the express (typically written) permission of the author. The information need not have a copyright notice or symbol associated with it to be copyrighted, since copyright protection arises as soon as an author creates an original work and fixes it in a tangible medium. The contents of a website are no different than the contents of a book or magazine in terms of copyright protection, even though web content is often seen as more "disposable" than works existing in a physical medium.

17.2 Also, any non-digital content that is protected by copyright law is automatically protected in its digital form as well. For example, a copyrighted novel published as a paperback will receive the same protection when it's published as an e-book. In addition to online content, databases (both electronic and paper files) also enjoy copyright protection as long as they show a certain degree of creativity by the author, such as in its organization or selection.

PHOTO AND VIDEO DISCLAIMER 

We Are One Foundation (WAOF) reserves the right to use any photograph/video taken at any event sponsored by WAOF, without the expressed written permission of those included within the photograph/video. WAOF may use the photograph/video in publications or other media material produced, used or contracted by WAOF including but not limited to: brochures, invitations, books, newspapers, magazines, television, websites, etc.

To ensure the privacy of individuals and children, images will not be identified using full names or personal identifying information without written approval from the photographed subject, parent or legal guardian

A person attending a WAOF event who does not wish to have their image recorded for distribution should make their wishes known to the photographer, and/or the event organizers, and/or contact WAOF at We1Are1@gmail.com, in writing of his/her intentions and include a photograph. WAOF will use the photo for identification purposes and will hold it in confidence.

By participating in a WAOF event or by failing to notify WAOF, in writing, your desire to not have your photograph used by WAOF, you are agreeing to release, defend, hold harmless and indemnify WAOF from any and all claims involving the use of your picture or likeness.

Any person or organization not affiliated with WAOF may not use, copy, alter or modify WAOF photographs, graphics, videography or other, similar reproductions or recordings without the advance written permission of an authorized designee from WAOF.
